Augsburg Labour Court: jurisdiction and the three-week deadline
A dismissal starts a hard deadline. Under § 4 sentence 1 KSchG the unfair dismissal claim must reach the labour court within three weeks of receipt of the written notice, otherwise it counts as effective from the outset under § 7 KSchG. Jurisdiction lies with the Arbeitsgericht Augsburg at Frohsinnstraße 2, also for the districts of Augsburg, Aichach-Friedberg, Dillingen, Donau-Ries, Günzburg and Neu-Ulm. The court first lists a conciliation hearing; if that fails, the chamber hearing follows. How the deadline works out where notice takes effect at the end of the month is set out in our guide on dismissal at the end of the month.
What a specialist employment lawyer in Augsburg costs
Fees follow the RVG and the value in dispute. In disputes over the continued existence of the employment relationship, § 42(2) GKG caps the value in dispute at one quarter of a year’s pay, and the courts regularly apply that cap in full. At first instance each party bears its own legal fees under § 12a(1) ArbGG, the winning party included. Employment law cover takes effect three months after the policy starts under the GDV model conditions ARB 2021; legal aid is governed by § 11a ArbGG. Worked examples are set out in our guides on what an employment lawyer costs and on who pays the lawyer in employment law.
